Mel B has lost her final court appeal in the defamation case brought by Lorraine Gilles – meaning the former nanny can now reveal all about their intimate love affair in front of a jury, DailyMail.com can disclose.

The former Spice Girl will go to trial over claims she called Gilles, 27, a 'homewrecker' and a 'prostitute' in legal papers – a battle which if she loses could cost her a whopping $2 million.

Los Angeles judge Dalila Lyons has already encouraged the duo to settle out of court.

The decision means yet more revelations surrounding Mel's private life will almost certainly be aired in public.

Despite the pair signing an NDA, Gilles is now free to take the stand and talk openly about Mel.

The trial will likely include details of Mel and her ex husband Stephen Belafonte's sex life including how they enjoyed threesome sex with German-born Gilles.

The former nanny is suing Mel, 43, after the star claimed she had an affair with Belafonte, also 43.

Mel's legal rep had tried to stop Gille's defamation action at the Stanley Mosk Courthouse in Los Angeles, arguing Mel had no choice in naming the former nanny to get a restraining order against Belafonte.

But Judge Lyons disagreed and the case was sent to trial. According to the court docket Mel then filed an anti-SLAPP motion which was denied.

Mel then lodged an appeal with the Court of Appeal but again she was knocked back.

And on Wednesday a final appeal lodged with the Supreme Court was outright rejected.

It's unclear when the expected seven-day trial will take place, although it is likely to happen early next year. A status conference has been set in the case for February 4 next year.

Mel made several allegations in declarations in support of restraining orders against Gilles and former husband Belafonte – orders that have since been dropped.

She claimed that Gilles was having an affair with Belafonte and he paid her 'in excess' of $300,000 over three years for her work as a nanny – an allegation which has since been disproven by forensic accountants.

She says Gilles became pregnant by Belafonte in 2014 and that he used her money to pay for Gilles to have an abortion.

Gilles said she did become pregnant but as a result of a one-night stand with another man, not from having sex with Belafonte, and she did have an abortion.

She also admitted to having sex with Belafonte but only when Mel was present.

Gilles claims in legal docs that Mel seduced her when she was aged just 18 and they had a seven-year sexual relationship – a fact Mel later admitted was true despite saying the opposite when she first filed court docs.

In the legal paperwork Gilles said that Mel 'seduced a naive and a curious 18-year-old foreign exchange student … with alcohol, fame, and casual sex.'

The blonde, who now works as a waitress in Hollywood, is seeking unspecified damages and is suing for libel, invasion of privacy, and intentional infliction of emotional distress.

A source close to the case said: 'Mel has been trying to keep Lorraine silent the longest, she knows more than anyone what happened Mel's marriage to Stephen.

'But now at a jury trial she can reveal everything, there's no holding back.

'Lorraine had no choice but to settle her restraining order because the legal bills were getting so high.

'But the judge said she did have the right to sue for defamation which she decided to do.

'All of Mel's appeals have now been rejected so the trial is on.

'Lorraine has a mountain of evidence to present including all the sex tapes and videos of (alleged) drug use submitted as part of Mel and Stephen's divorce battle.

'Because Lorraine was involved in that, all parties had to share all of their evidence with one another's lawyers, so she has absolutely everything.'
